Abstract of record A short, abbreviated form of the case as found in the record. Incarceration Imprisonment; confinement in a jail or penitentiary. Bail In criminal cases, a sum of money posted by or on behalf of a defendant to guarantee his appearance in court after being released from jail Allegation The assertion, declaration, or statement of a party to an action, made in a pleading, establishing what the party expects to prove. Objection The act of taking exception to some statement or procedure in trial or other proceeding. Used to call the court's attention to improper evidence or procedure. Counterclaim A claim presented by a defendant in a civil proceeding in opposition to the claim of a plaintiff. Docket A brief entry or the book containing such entries of any proceeding in court. Delinquency The commission of an illegal act by a juvenile

	The mediation process may vary depending on the mediator. Generally, mediations commence with a general session with all parties, counsel and the mediator. At the general session, there will be a discussion of the case, the issues on appeal and other matters important to settlement. Then the mediator will meet separately with each party and their counsel in separate "caucuses." In these separate sessions, the mediator will seek to foster negotiations between the parties and develop agreement.
